1. Acceptance of Terms

By accessing our website at www.tyrerescue.net, booking our services, or using any service provided by Mobile Tyres Rescue Ltd ("we," "us," "our," "the Company"), you ("customer," "you," "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and Mobile Tyres Rescue Ltd. Please read them carefully before using our services.

1.1 Compliance with UK and Scottish Law

These Terms of Service are designed to comply with all applicable UK and Scottish legislation, including but not limited to:

  • Consumer Rights Act 2015
  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
  • Unfair Contract Terms Act 1977
  • Supply of Goods and Services Act 1982
  • UK Data Protection Act 2018 and UK GDPR
  • Consumer Protection from Unfair Trading Regulations 2008
  • The Companies Act 2006
  • Scots Law governing contracts and consumer rights

Where these Terms conflict with UK or Scottish statutory consumer rights, your statutory rights will prevail.

As a Scottish registered company providing services exclusively in Scotland, we operate under both UK-wide legislation and Scots Law.

1.2 Your Statutory Rights

IMPORTANT:

Nothing in these Terms affects your statutory rights under UK law. As a consumer, you have certain legal rights under the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and other UK consumer protection legislation. These Terms do not and cannot exclude or limit these statutory rights.

Your statutory rights include (but are not limited to):

  • The right to receive services with reasonable care and skill
  • The right to receive goods of satisfactory quality
  • The right to receive goods fit for purpose
  • The right to a refund, repair, or replacement if goods or services are faulty
  • Protection against unfair contract terms
  • Cancellation rights for distance and off-premises contracts (subject to certain exceptions)

These Terms are in addition to, and do not replace, your statutory rights.

2. Service Description

Mobile Tyres Rescue Ltd provides mobile automotive services throughout Scotland, including but not limited to:

  • Mobile tyre fitting and replacement
  • Tyre repair services
  • Vehicle breakdown recovery
  • Car towing services
  • Battery jump-start services
  • Emergency roadside assistance
  • Vehicle recovery services

All services are subject to availability and operational capacity. We reserve the right to refuse service at our discretion, particularly in cases where safety conditions are not met or where service provision would be unlawful.

3. Service Area

Our service area covers Scotland. Service availability may vary depending on your location, time of day, weather conditions, and current demand. We will inform you if your location falls outside our service area at the time of booking.

Due to Scotland's geography and weather conditions, some remote or Highland areas may have limited availability or additional charges. We will always inform you of any restrictions or additional costs before confirming your booking.

4. Bookings and Appointments

4.1 Booking Process

  • Bookings can be made via our website, phone, or email
  • All bookings are subject to confirmation by Tyre Rescue
  • We will provide an estimated arrival time, which may be subject to change due to traffic, weather, or other unforeseen circumstances
  • You must provide accurate vehicle and location information when booking

4.2 Booking Confirmation

A booking is only confirmed when you receive written or verbal confirmation from Mobile Tyres Rescue Ltd. We reserve the right to decline any booking without providing a reason.

As our services are provided at a location of your choice, bookings may constitute an "off-premises contract" under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. However, please note that once services have been fully performed, your right to cancel may be affected (see Section 6 for full details).

4.3 Waiting Time

Our technicians will wait for a reasonable period (typically 15 minutes) at the agreed location. If you are not present or contactable, we reserve the right to leave and charge a callout fee.

5. Pricing and Payment

5.1 Pricing and Transparency

  • All prices are quoted in British Pounds (GBP)
  • Prices include VAT at the current rate (VAT rate will be shown separately on invoices)
  • We will provide a clear quote before commencing work
  • Prices quoted are valid for 24 hours unless otherwise stated
  • We will inform you of any price changes before commencing work
  • You have the right to refuse services if you do not agree with the quoted price

5.2 Payment Terms

  • Payment is due upon completion of service unless alternative arrangements have been agreed in writing
  • We accept cash, card payments, and bank transfers
  • You agree to pay all charges incurred for services provided to you or on your behalf
  • Failure to pay may result in legal action and additional recovery costs being charged to you

5.3 Non-Refundable Deposits

Deposits are non-refundable in the following circumstances:

  • If you cancel your booking (regardless of notice period)
  • If you are not present at the agreed location
  • If you refuse access to your vehicle
  • If service cannot be completed due to your actions or omissions

This deposit policy does not affect your statutory rights. If we breach the contract or fail to provide services as agreed, you may be entitled to recover your deposit under UK consumer law.

6. Refund Policy and Your Cancellation Rights

Your Statutory Rights:

This refund policy does not affect your statutory rights under UK consumer law. You retain all rights under the Consumer Rights Act 2015 and other applicable legislation.

6.4 No Refunds on Fitted Tyres (Subject to Statutory Rights)

Once a tyre has been fitted to your vehicle and payment has been taken, refunds will not be provided except where required by law. This is because tyres are supplied as new products and once fitted, cannot be resold as new.

This policy does NOT affect your statutory rights. You remain entitled to a refund, repair, or replacement if the tyre is faulty or not as described.

7. Cancellation and Rescheduling

7.1 Customer Cancellations

  • Cancellations made more than 2 hours before the scheduled appointment time will incur no charge
  • Cancellations made less than 2 hours before may incur a cancellation fee of up to 50% of the quoted service price
  • Cancellations made after our technician has been dispatched will incur a full callout fee

Important Consumer Information

  • • These Terms do not affect your statutory rights as a consumer under UK and Scottish law
